The Director of Public Prosecutions (DPP) is set to prefer murder charges against Safaricom-sponsored rally champion Maxine Wahome.

State prosecutor James Gachoka told Milimani senior principal magistrate Bernard Ochoi that circumstances in the matter have changed following the death of Assad Khan. "The circumstances in this investigation have changed following the death of Assad last December. Maxine is now being investigated for murder and grievous harm I request the matter to be mentioned in 14 days," Gachoka said.

The family of Assad has engaged lawyer Cliff Ombeta to appear for it in the matter.

Maxine was last month arraigned over the alleged assault of her boyfriend, top rally driver Asad Khan.

A court report stated that police had visited the scene and found blood and household goods littered on the floor and staircase.

She was released on a Sh100,000 cash bail after spending two nights in custody.

Days later, Khan was pronounced dead at Avenue hospital where he was receiving treatment following the incident.

He had initially been admitted to the Nairobi Hospital’s High Dependency Unit (HDU) with serious deep cuts on the right ankle.

His death prompted police to summon six key witnesses, including Maxine, for interrogation and recording of statements.

She was presented at Kilimani Police Station for a three-hour grilling session.

Her saliva samples were taken for DNA profiling at the Government Chemist.

Asad, 50, was described as humble, generous and kind-hearted.

Alongside his brother, they headed a team of mechanics as members of the Service Crew for the Young FIA Team that participated in several events across the continent.

Asad was undergoing treatment at Avenue Hospital, where he was admitted after being transferred from Nairobi Hospital following the gruesome incident that happened during an altercation at their apartment in the leafy suburbs of Nairobi.

The suspect reportedly inflicted a stab wound on her boyfriend’s ankle, causing him to lose a lot of blood.

The matter was reported to the Kilimani Police Station and when they rushed to the scene, they found Maxine in the house looking disturbed.

She was arrested and her boyfriend was rushed to one of the city hospitals where he was placed in the High Dependency Unit (HDU) on Monday, December 12, and later transferred to the ICU.

On Wednesday evening, Asad’s family confirmed he had passed on.

By the time of going to press, a team of detectives had flocked to Avenue Hospital, with the matter now escalated to a murder case.

Njuguna is known to be lazy, always coming to the office late and disappearing from the office for hours on end subordinating his tasks to his juniors and has little technical competence in the IT field.

The technical IT people under him are the people who really undertake the work and fat blob Njuguna just sits around, barking orders and playing petty politics and witchhunt.

So little is his proficiency in the IT technical field that when he sees an email exchange between IT staff or with IT vendors on highly ICT technical matters where he is in a copy of these emails, he replies back to the emails stating that he should not be copied on such emails in the future which is shocking and evidence that he has little technical knowhow.

He is also malicious and sadistic, affecting a high staff turnover in his docket.

Whenever he joins a new organization, he proceeds to sack several of his subordinates for the flimsiest reasons to replace them with his goons, some of whom aren’t even qualified for the job.

His solution for every small problem with a subordinate, whether real or imagined, is summary dismissal.

To make things worse, he is a hypocrite who pretends to be supportive and empathetic to his subordinates' plights during his witch hunts and summary dismissals, yet he is the same one who backstabs, gossips and sacks staff with sadistic malice.

While he was Chief Information Officer at the dubious, cash-strapped, corrupt-ridden HF Group, pampered fat boy Njuguna outmanoeuvred the highly knowledgeable and hardworking General Manager of Operations George Mutua, who was nearly 20 years older, to become his boss.

The pampered boy is also extremely corrupt demanding bribes from vendors for both software and hardware ICT procurement.

For example, Safaricom has repeatedly lied about 11.5 million customer data leaks even in court. The objectives of a profit-extracting water company can conflict with the public interest. This means that Safaricom and the water service providers will cherry-pick where to shut taps and when to open them. We've seen this behaviour in terms of road networks where private housing firms have captured govt agencies to control where good roads are constructed. In the end, it is the consumer that will suffer unnecessarily high water bills. Safaricom in it Safaricom is flourishing in the kadogo economy, billing Kenyans to death due to the failure of the Central govt. Though not new, this is the only time it has happened d en masse. The worst part is that for a second time in a row, we noticed that Safaricom didn't find it responsible to inform their clients. People were left to grapple with the inefficient Safaricom customer service to try to reverse their money. Truly irresponsible. Moving on, the issue is that, a client reported a problem with some transactions that has caused him so much pain. Good morning Cyprian, There's a problem with Mpesa and they have not communicated this to us. I went to hospital this morning and paid via till number. I did the first transaction but the pop up message didn't come, and I also didn't receive the Mpesa message for close to 10 minutes. I assumed the transaction hadn't gone through because when I checked my balance, all was okay. So I did the second transaction. This time round I got the confirmation message almost instantly. I left for my house. 1 hour later, I'm getting another message that my first transaction went through. So they have debited my account twice. The same has happened again when I was buying airtime for someone this morning. Double transactions initiated. I have called there customer service and they say there's a problem with their system but they not yet sent out a communication to their customers. See attached screenshots. Every time the matter comes before parliament, it is defeated. The last time a serious debate was to take place in Parliament is August 2021. The Kenya Information and Communications (Amendment) Bill sponsored by Gem MP Elisha Odhiambo sought to address concerns that Safaricom has become too big through its dominant market share in voice, mobile data, and mobile money. Currently, Safaricom controls 99.9 percent of the mobile money market. It simply has no challenger. Safaricom also controls over 65 percent share of the voice market. In the Elisha Odhiambo bill, only two out of 349 legislators showed interest in debating its content. Mr Odhiambo and his Nyando counterpart Jared Okello were the only lawmakers who contributed to the debate on the Second Reading of the Bill. “Only two members had spoken to the Bill. Honourable Odhiambo who moved debate and Jared Okello who seconded. I can see no other interest. This means that the mover be called to reply,” Moses Cheboi, the Deputy Speaker said as he ordered that no further debate will be taken on the Bill once the matter comes up again. It is an open fact that Kenyan MPs are so cheap, and can be bribed for less than Sh10k each. You can join the dots on why Safaricom has never been split from MPESA. More parents, former students and those in the know have come forth with fresh information. “And something that happened immediately schools were closed, our principal Mr Maina asked all students to pay ksh.1000 so that he can bring exams for us almost 3/4 of the students paid and by the time we were starting our exam we had not seen any exam paper were asked the principal what happened he said that the person he was working with from KNEC has refused to give out the exam and he has been able to get only practical questions of which the question our sciences teacher had predicted when they were asked to prepare the lad with the apparatus and reagents. As I told you before were separated students who did their exams from the victory were told they will have to for the money they had given out to the principal if he returns the money and students from Anestar victory boys who did their exams in Anestar mountain we refused to what the principal was saying and he gave us ksh.500 every student who give him money. When we were done with our exams were we returned to Anestar victory boys and all parents were asked to come for their students and we paid Ksh.2000 since we were given back Ksh.500 by the principal, for the students who did their exams in victory they never paid anything”, confessed a parent . The said SAFARICOM PLC manager was a known husband to the late Christine Kajuju Mwito who died on 23rd February 2022 .Christine Kajuju Mwito was an OPPO sales representative at Muranga County. The late Christine Kajuju Mwito was blessed with a baby girl on 29th November 2021. PAUL KABERIA and the late Christine visited Christine’s family on 8th may 2021 when PAUL KABERIA was introduced to the family of the deceased as the husband to the late Christine. After the introduction he was requested to follow the normal marriage process which he agreed to do in the month of July in the same year of which he didn’t because he claimed that his late mother was sick that why he changed the plans. During his stay with Christine he kept calling our father promising that he will do what they had agreed concerning the marriage process. During the burial of PAUL KABERIA’S mother, Christine was even included in the eulogy as the wife to PAUL and this can be attested by the following photos. After the demise of our sister Christine Kajuju Mwito the purported husband by the name PAUL KABERIA abandoned our family and refused to bury Christine claiming his family land had not gone through succession process .This was a lame excuse because he has a home at Kiambu county Thika Makongeni landless phase Two where he resides. PAUL KABERIA later notified us that it was shameful for him to bury Christine because she wasn’t his wife known to the public domain but just a mere girlfriend. He further argued that the public knows that they divorced with his wife who stays in USA and he only lives with his son. When Christine died he went to police station and recorded Occurrence book OB NO; 07/23/02/2022 where he indicated that he was travelling with a friend who got sick on the way and after taking her to Maua Methodist hospital that is when she died. At Maua Methodist he recorded that the late Christine was just a simple girlfriend not his wife and informed Maua Methodist medical officers that he was not ready to handle anything concerning the demise of Christine and her burial to the extent even during the time of giving records she provided the phone contact of the late Christine to be contacted by hospital in case of any inquiry by the hospital. We don’t know why he gave contact of the dead person. After medical officers and staff Methodist hospital demanded more questions concerning the death of Christine he turned to be offensive to them and telling them that they couldn’t force him to be the late Christine’s husband despite staying with her. He was requesting medical officers to record contrary opinion regarding the death of Christine. In simple Paul started causing confusion with untrue stories concerning the death of Christine and being rude to our family and to friends of the late Christine. After Christine died, PAUL came in my sister’s home where Baby ARIELLA FARAJA KENDI and the house girl were and instructed the house girl to pack everything and leave the room very fast. When two friends of the late Christine followed them to see where they we going with the baby PAUL KABERIA locked them outside the gate of his brother who resides at MAUA and instructed the owner of the house not to open the gate to any person who wanted to see the baby. I thought I could be at the position of seeing my niece but up to date I have never seen the baby. This guy has caused a lot of pain to family and friends which can’t be healed. Even now am shedding tears while writing this sad story. PAUL KABERIA didn’t even constitute a single burial committee to help us to bury Christine. In simple terms he didn’t contribute even a single coin towards the burial of the deceased. He didn’t even notify his colleagues or friends about Christine’s death including those who knew their relationship. He kept the death of Christine secret and he didn’t want anyone in his working station or even neighbors at Muranga where Christine was living and also his neighbors and friends at Thika Makongeni phase 2 where he resides. His contribution was to send his relatives to burial preparation committee to investigate how things were going on and to hack our conversation through phone calls using his manager powers at SAFARICOM PLC. We suspect that even to date he is using SAFARICOM PLC managerial powers to hack our family and friends phone call conversations and messages to monitor with the intention of causing more harm to the family. Tell-all picture. As if that was not enough, PAUL KABERIA continued to cause more pain to our family and friends of the late Christine and cared less about the death of Christine. PAUL KABERIA with the help of the house girl known Susan (karembo) disappeared with the late Christine’s baby aged 3 months .PAUL blocked us from accessing our sister’s baby and went claiming that he is the legal father while no relevant authority with competent jurisdiction has given him such permission. Up to date we don’t know how the baby is doing because PAUL KABERIA blocked us from accessing the baby or get any communication concerning the welfare of the baby. PAUL KABERIA blocked our contacts and also urged his house girl to do the same so that we can’t know anything about the baby. We pleaded with him to bring the baby to bury her mother but he disappeared with the baby before the burial date and he didn’t even come to the burial too. When we arrived at our home to lay Christine to rest after church service we met some of the Christine households dumped at our home by a person believed to have been sent by PAUL KABERIA because he refused to be accompanied by family member to pick the belongings of the late Christine at Muranga County where Christine was residing. We are demanding PAUL KABERIA ID NO 11256565 to give us our sisters baby named ARIELLA FARAJA KENDI we take care of her because he said Christine was not his wife but a mere a girlfriend who was not known. According to us PAUL KABERIA is a thief since he has stolen the baby of our late sister Christine. What is he doing with baby whose mother was girlfriend whom she didn’t even recognize or accord her last respect on earth? If she disrespected and abandoned the dead body of my sister what about the baby of the deceased? The client is wondering how can such a profitable (of scams) company promise heaven but deliver hell in terms of network coverage; one of its core business.

According to sources, MS Atika who has over 23 years experience in the Telecommunications industry quit a few weeks ago 'due to frustrations by the CEO and unrealistic targets'.

"Notable senior personel are leaving for Microsoft and the latest one who serving her notice is the Director for Customer Experience. Some departments are understaffed thereby directing a huge overload of work to the personnel present," a source claimed.

I wish everyone, including Safaricom, would believe that my coming out to warn on this is inevitable. It’s not good for someone to divulge details about their personal life at this level, but I feel this is necessary. So, read, tell Safaricom and be warned. Here we go. Be patient and follow to the end: Let me preempt an important question many of you may be asking. Am I able to use a phone and transact on MPesa as someone with visual challenge by myself? The answer is “Yes.” Now that we have this out of the way, read carefully: Shortly after Midnight, the morning of 18th November, 2021, at 12:33 A.M. my colleague sends me 10,000 shillings for my flight to Nairobi because of an urgent meeting that had come up. In the morning at 6:43 A.M. I sent kshs6,800 to Jambo Jet for my ticket. My MPesa balance read kshs3442.95. My team drove me to Eldoret International Airport where I was handed over to the Airport security for the scanning of my bags and escort to check-in. The routine procedure was smooth and fast. I handed in my luggage, customarily removing my laptop and putting it on the tray together with my phone, belt and watch. I was quickly helped onto the other side of the scanner and handed my items including my phone. Because I was getting late for the flight, everything was done pretty fast. … I was escorted to board and I left for Nairobi. At JKIA I was received by the ground crew and security and handed over to my team which was waiting at the VIP parking. We drove off and proceeded to the venue of the meeting. Along the way, my Assistant says it is important for us to stop and fuel. I told him we were in a hurry and that I did not have enough money for the day’s events but that I could use my MPesa to put a little fuel to save us on time. We pulled into a gas station and I told him to fuel. Because it was not our favourite petrol station, we agreed we can put in kshs1000 and then fuel later. When I sent the money to the Till number provided, I was greeted by a big shock: The message read “failed. Transaction cost, Ksh51.00. … WHO MOVED MONEY FROM MY PHONE TO MIKE ISALAMBA, someone I do not know? Someone I have not interacted with? Someone not at the airport, following investigations? Who is he? Who accessed a phone that was in my custody all the while? Since I was being helped by Security, I needed to check in. Once we boarded, I put my phone off, as is required. Before you think I am joking, I have consulted and followed up with the Airport Security at Eldoret International Airport and they have reviewed the CCTV footage carefully and confirm they can see me and all my movements including the check-in and also confirm that they do not see me or anybody using my phone at the time the incident happened. So why do I put everything at Safaricom’s desk and warn you about MPesa safety? When I got the message that I did not have enough money on my phone and saw the mystery transaction, I immediately called Safaricom Customer Care. They told me they had received the info and had escalated the matter to their anti-fraud department and that Safaricom would get back to me within 48 hours. They did not and so, about 10:00 A.M. on Saturday, 20th November, 2021, I called again and this time I was told Safaricom would get back to me within two hours. They did not. On Monday, 22nd November, 2021, I called in the morning to find out the progress. I was told by the Customer Care that the Issue was still pending and that someone would call me by end of day. Nobody did. I called the Eldoret Safaricom shop and reported the case on the same day and they told me they were following it. Two days later, on the afternoon of 24th November, I called again and I was advised just to be patient and that the Issue was still being looked into. I asked why all the previous promises had failed and told I just needed to be patient. The next day, 25th November, I felt it necessary to report the incident to the police and so I filed the case at Naiberi station in Eldoret. I escalated the information to the Airport Police Station and decided to wait. Well, I decided to call one more time this afternoon before going public. I was told to wait on the line. I did. The next thing I noticed, the Safaricom automated service was asking me to rate the service I had received, whether I was served well, and, all, at the scale of 1-10 whether I would recommend Safaricom to someone else. Well, you can imagine how I graded Safaricom!.. am I a patient person? Maybe not! Meanwhile, my call to Mike Isalamba received the usual, “cannot be reached … we have notified him…” and my text inquiring about the same to him also goes unresponded to. I contacted him just a couple of days ago, having taken this long to give Safaricom the maximum time to help me. Nearly one month after the incident, a digital company cannot tell me how someone knew exactly how much I had left on my MPesa to be able to withdraw the maximum amount. They cannot tell me who Mike Isalamba is. They have not refunded my money and the inconvenience and embarrassment caused. They cannot explain why the matter could not be resolved in 48 hours. Nobody has talked to me. Conclusion: You can lose money on the Safaricom MPesa App without trace for nearly a month or more. Do I say this because I hate Safaricom? No. Do I have anything against the company? No. Is my money lost under their watching eye? Yes. Do you have a reason to fear? Yes.

CAPTION: Social media influencer "Miss Mati" alias Kasungwa, who lost money after a bungled NCBA Bank transaction A disgruntled customer is in search of answers after she mysteriously lost cash during a botched transaction facilitated by one of the top banks in the city.

Taking her frustrations to social media, the lady identified as "Kasungwa" revealed how a simple mobile money transfer from NCBA Bank Kenya to M-Pesa turned into an excruciating process that has now dragged on for over 24 hours.

According to Kasungwa, she initiated a successful mobile transfer from her NCBA account on Monday 29 November 2021, but to her surprise, the money did not reach her M-Pesa account.

In a bid to solve the puzzle, she reached out to the bank's customer care department who insisted that the transaction had been successful on their side.

On checking her account balance, she confirmed that the figure had been deducted.

This prompted her to reach out to Safaricom hoping to find out why the cash was not reflected in her M-Pesa account.

Things got even more twisted here.

The company claimed that the code she had received from NCBA Bank for the transaction was old void. "Jana I did a mobile transfer, it didnt go through but the money was debited from my account. According to NCBA the transaction was successful. The transaction ID according to Safaricom is an old one dated 25/8/2021. Armed with this fresh information, she returned to the bank expecting an explanation.

This time around, an attendant at NCBA claimed that the mobile number linked to her bank account matched another identical number but from a different service provider.

In simpler terms, her Safaricom line somehow shared the exact same unique digits as a different Airtel line owned by someone else. "I visited one of your branches, the guy says my safaricom line its tied to Airtel, he called it "porting ", she narrated. The attendant went on to insinuate that the funds which failed to reflect on her Safaricom sim card might have ended up wrongly deposited to the Airtel line. "[He told me] that the same number could be belonging to 2 different Provider and that the transaction went to the same number but tied to Airtel and upto now sielewi what that meant," she wrote in distress. Kasungwa's Twitter thread quickly garnered traction as netizens flocked under the posts in bewilderment.

Just like her, they simply couldn't make sense of the whole fiasco.

Some quickly settled on the conclusion that the lady had been a victim of broad daylight robbery and advised her to seek intervention from higher power within the banking industry. Another one confessed to having faced a similar issue when using NCBA Bank's services.

In his case, he explained that the funds were refined after up to three weeks. She was also advised to demand account statements from both Safaricom and NCBA Bank to help her figure out who between the two firms is taking her for a ride. The NCBA to M-Pesa service is one of the bank's most popular services.

It allows customers to withdraw money from their NCBA bank accounts straight to their Mpesa wallets.

This is made possible through the NCBA mobile banking app or uses the NCBA loop pay bill number to transfer money to other bank accounts.

As of the publishing of this post, the bank was yet to comment on the matter.

Safaricom Plc has deteriorated in service over the past few years.

Bob Collymore, immediate former Safaricom CEO died abruptly in July 2019. Since then, there have been curious happenings at Safaricom.

First, the data bundles system suffered numerous problems in 2020. Subscribers had a hard time accessing internet sites.

Secondly, when Airtel and Telkom merger was in the cards,  the call drop rate went up. Safaricom obviously sabotaged the Airtel-Telkom merger by flexing its muscle as it runs a bigger chunk of the economy. It was hard to call a Airtel or Telkom line from Safaricom line. Remember Safaricom also asked to be repaid what the two Telcos owed it. They failed.

Thirdly, banking fraud involving Safaricom lines have increased, the prisoners at Kamiti Maximum have always devised new ways of conning Kenyans that must have the blessing of Safaricom staff to pull. Safaricom fired 28 employees in the year ended March 2021 for fraud-related offences, a jump from 16 dismissals the year before. The telco’s latest sustainability report released Wednesday indicated it conducted 36 investigations into alleged fraud, dismissed the 28 and warned 19 employees. - Business Daily Fourthly, there is just a gut feeling that things will not be right at the end for Peter Ndegwa at Safaricom.

If we had cases of fraud at the Telco Giant, then maybe just maybe that has increased; taking advantage of a newbie, an outsider coming into the fold.

The old faces, Michael Joseph aka Mr 10 per cent and Sylvia Mulinge don't really love the guy.

You may have noticed in the recent past there has been a long call waiting time when calling Safaricom customer care numbers. Contract Customer care agents are on a go Slow. Some have worked for 7 good years on contract without being confirmed to permanent. Those who can’t hold on anymore have opted to resign. In the last 2 months alone the company has seen a record number of customer care agents resign, something that has never happened in the 2 decades the company. The customer care agents are overworked and yet poorly paid. Some have left with their ears permanently damaged while other have heard their spinal cords permanently damaged as a result of long working hours. The few Agents that are seen to advocate for conversion of contract staff to permanent staff have been targeted and fired under flimsy grounds. If thieving Telco firm Safaricom Plc promises to give you something for free, run, if it promises to provide something for cheap, also run.

On 20th September 2021, Githeri Media screamed about a partnership between Safaricom and KPLC for smart meters where the Telco claimed that the new tech will save the struggling utility firm billions of shillings.

What was not said in the well-calculated propaganda is that, first, the smart metre contract has flouted procurement laws by direct tendering.

Secondly, the smart metre contract will run perpetually, which means Safaricom will be given the contract after every 4 years.

The Kenya Electrical Trades and Allied Workers Union (KETAWU) has raised issues with the arrangement.

KETAWU says that KPLC had already started implementing the smart metres with its big clients and that the project was at 85 per cent.

The Union wonders how the new contract was entered into and why it seeks to replace the already installed and brand new smart metres.

KETAWU Secretary General Ernest Nadome calls the agreement a scam. “This is a scam worthy more than Ksh5B and we would like the matter to be probed to its logical conclusion,” - said Nadome.

Safaricom managers pocketed a lot of money in the sh7 billion procurement of CCTV for Nairobi city. Those things became dysfunctional immediately. The assassination of Kikuyu MP George Muchai and the murder of prominent businessman Jacob Juma has never been solved.

Another scandal that has been swept under Safaricom's dirty carpet is the one involving a firm known as Fibre Space Limited.

Fibre Space Limited was single-sourced to roll out electronic payment in the transport sector.

The project proved to be a white elephant as it collapsed a few weeks after launch by President Uhuru Kenyatta.

It emerged that the tendering for the project didn’t involve a Request for Proposal as is the case with rightfully followed procedures.

The then head of business unit Sylvia Mulinge was implicated in the disappearance of contract documents and payments to Fibre Space Ltd running into Sh0.7 billion.

There’s discontent among the youth with the AJira Digital Project.

The Human resources functions of the govt and donor-led project has been brought to question even as govt officials shout hoarse how it is creating solution for the unemployed.

Touted as a mechanism ‘to bridge the gap between skills demand and lack of jobs’,  Ajira Digital beneficiaries allege that theirs is something fishy going on. Its eMobilis system that boasts over 150 employees, has no HR policy.

“Hi Nyakundi, please make this be known that eMobilis has no HR policy yet it has more than 150 AJIRA Digital employees. Medical Insurance given to only one person (No spouse or children cover). No employee benefits like bonuses. No payslip. Let Mastercard, MoICT, and KEPSA know that these people are frustrating the employees. Staff take more time reporting than working. Staff not allowed to have WhatsApp groups have resorted to use telegram”, a disgruntled youth wrote.

True reforms however would be in lower taxes, a level playing field in tenders, fewer and cheaper business licensing and a judicial system that works for the haves and the have-nots.

The coming together of cartels between the private and public sector feeds into each other to pacify youths that something is being done, and before long, they find themselves old, pst the youth age and disgruntled.

For example: Safaricom’s Blaze BYOB has targetted the wrong population of Youths; those who come from some well-to-do families, those whose life in campus is not as hard as such instead of focussing on the real youths from the ground. The Blaze BYOB PR is run on social media platforms such as Instagram, Twitter, and Facebook and to the average thinker, it appears like Safaricom PLc is helping those youths, while it is not. To all the downtrodden and oppressed youths of Kenya, there’s nothing tangible BYOB Blaze is doing for them. It is taking youths in circles, make them ignorant of what truly ails them, and when they wake up, they are already old, nothing has changed to better their lives or those of others. It is a scheme that the Kenyan government loves too much, they are this oppression together. To disenfranchise the lot of young people who make the bulk of the population of this country, so that they cannot interrogate their predicament in the lack of jobs, lack of money, and extra-judicial killings, but instead waste time chasing the wind; a proper chasing of the wind. A true revolution is one in which article 37 of the constitution is adhered to by the youth.

The case in which Safaricom Plc is accused of stealing the MPESA 1Tap invention was to be decided on  Friday, 17th June 2021. We have not got the 411 of it since then.

MPESA 1Tap product that used a visa-like card for purchases was launched in 2017 but immediately hit a deadlock after the inventor accused the firm of breaching the Non-Disclosure Agreement (NDA) signed in 2016.

The invention was supposed to augment LIPA NA MPESA as buyers would just ‘tap’ their cards to a point of sale and that’s it. Paid.

According to the user, Safaricom launched the product using ideas/knowledge that was bound by a non-disclosure agreement.

The inventor, who is a Twitter User by the name Gee Kadere recently shared the case cause list. MPESA 1Tap Card

The date was given as 17th June 2021 at the Milimani Law courts, High Court’s commercial division.

The MPESA 1Tap solution which has died a natural death thanks to the legal challenge was to provide merchants with point-of-sale terminals that were NFC enabled, and where users could complete the transactions. The Lipa na M-Pesa card was also Chip and Pin enabled, a measure adopted to improve the security of payments solution.

We have also cases where the innovations are stolen and improved, then introduced into the market. Many innovators lack the capacity to follow through in courts since the cost is prohibitive.

The Kenyan creative economy is under foreign attack

At the onset of Covid 19 Pandemic, the worst pandemic has visited Kenya’s thriving Creative economy. Kenya’s leading foreign creative agency, WPP SCANGROUP downsized many employees, The remaining few Kenyans have suffered mental breakdowns, others coerced to resign depriving many Kenyan families of their breadwinners.

Sacking staff due to covid was an excuse to engage foreign workers to do what Kenyan workers can do. This is against the Immigration Laws.

They have managed to deplete 90% of Kenya’s top creative staff and replaced them with an Indian Company called “Mystic monks” – a Delhi based company, who are now mysteriously handling iconic Kenyan brands such as Safaricom, KRA, KCB and EABL jobs amongst others. This explains why Safaricom performed poorly against the complaints on Home Fibre and Mpesa Bill Manager for Businesses. It is worth noting and painful that ScanGroup charging the hefty fee in the account of creative duties and paying to other countries at the expense of Kenyans. This not only deprives Kenyans of an opportunity to pay taxes due to job loss, and destruction of dreams of young Kenyan creatives but more painfully unfairly making other foreigners pay tax to their economies.

It is worth noting and painful that Government agencies such as KRA, which exists through the painful tax-paying Kenyans are made to employ foreign consultants such as the mysterious “Mystic Monk” based in India amongst others.

The leadership of ScanGroup have been working in Kenya in blatant disregard of Kenya’s immigration policy (SECTION 34 of the year 2012) that states no work permit should be renewed for more than 5 years. They have fraudulently retained foreigners over decades for jobs Kenyans are qualified to successfully undertake.

It is noteworthy that WPP ScanGroup unearthed these serious malpractices and the report never made public since they evicted the founding CEO Bharat Thakrar.

This is a request on behalf of the creative economy to this honourable house to quickly move in and save our nation.

There exists several documented cases (Medical reports included) of mental breakdown frustration and ultimately resignation.

It is unfair to make people work overnight against labour laws and the constitution that guarantees a fair and reasonable work environment for Kenyan citizens in their own country.

Peter Ndegwa, CEO Safaricom Stockholm Syndrome is a psychological phenomenon where “hostages or abuse victims bond with their captors and abusers.” This bonding can occur over days, weeks, or months of captivity and abuse. Rather than being terrorized by their captors, hostages sympathize with them, developing positive feelings, sharing common goals and causes, and essentially falling in love with their captors. The story behind the Stockholm Syndrome is a 1973 six-day hostage event in a Swedish bank. By the second day, “the hostages were on a first-name basis with their captors, and they started to fear the police more than their abductors. ” By the end of the hostage crisis, “the convicts and hostages embraced, kissed and shook hands.” A modern-day version of the Stockholm Syndrome is playing out after over a decade of Safaricom captivity. Kenyans have been held hostage by notorious Telco Safaricom which is colluding with the likes of Communication Authority Of Kenya (CAK), Opus Dei Patrick Njoroge, who doubles up as the CBK governor and Kenyan media oligarchs. Stockholm Syndrome How then could one explain some Kenyans responses under a popular tweet that sought to ignite a conversation regarding the expensive Mpesa charges? From the dates shared above, it wont be  ignorant to conclude that Mpesa has become the major Safaricom money-spinner, behind the success story...lies the details Early this year, there was a controversy over the Safaricom Home Fibre revamping. We uncovered it under the article “No Love In The Connection’ As Safaricom’s Con Is Exposed Over Revamped Home Fibre " A 2019 report by Egyptian investment bank EFG Hermesdubbed dubbed Mobile: Deepening Financial Inclusion But at a High Cost, noted that w ithin East Africa Region, Kenya leads in terms of adult mobile penetration, followed by Tanzania, Rwanda and Uganda. The report also showed that whereas there is improvement in the penetration of mobile banking across sub-Saharan Africa, transaction costs still remain high. In Kenya, the cost of sending and withdrawing $5 through Safaricom’s M-Pesa platform is currently fixed at nine per cent of the value of the transaction. " Borrowing through Safaricom’s overdraft facility Fuliza is more expensive for smaller amounts. The report notes that the effective cost of borrowing $1 on your mobile using M-Shwari and Fuliza accounts in Kenya is 7.5 per cent per month and two per cent per day. However, the annual percentage rate (APR) of borrowing $25 on Fuliza is only 17 per cent, implying that Fuliza is disproportionately expensive for the poor that they claim to be uplifting and working for" “If the costs of mobile transfers are high, the cost of borrowing on the mobile is usury. This is particularly true of Safaricom’s latest overdraft facility — Fuliza. The effective cost of borrowing $1 from Fuliza is two per cent per day with an APR of 137,641 per cent. However, the cost of borrowing $25 is 0.04 per cent per day with an APR of 17 per cent. “While we are encouraged by the depth of mobile banking across sub-Saharan African countries, we believe that now is the time to focus on the costs and would encourage both the central banks and ICT regulators to review the cost of this financial inclusion because the current tariff rates are disproportionately expensive for the poor.” “With regard to Kenya in particular, we strongly believe that it is absolutely inconsistent to regulate bank lending rates and not all borrowing rates. Competition on a level playing field is all that is needed to bring down tariffs and rates across sub-Saharan Africa,” the report says. It however remains a mystery as to how Safaricom has managed to suppress this conversation but Kenyans must beware of Safaricom planted bots that normalize everything with statements like " Safaricom is efficient if you don't like Safaricom quit, Safaricom is better than others". Why the CBK has not implemented some suggestions in these great reports reveals how Safaricom has managed to bully and control all the sectors of the Kenyan economy, something that may not hold for life. Yes, It is time we have a conversation about high Safaricom Mpesa Charges because we know the Mpesa agents risk the dangers of being attacked by criminals as they make money for the most profitable company, but get very small returns,  something that needs another conversation too.
