Lawyer Elisha Ongoya on Monday told the High Court that the impeachment proceedings against Rigathi Gachagua followed a predetermined outcome, comparing them to historical trials conducted with conclusions already set, and describing the process in Parliament as one of “malicious compliance.”
He argued that senators denied the Deputy President additional time to prepare his defence without giving reasons and relied on legal provisions he said had already been declared unconstitutional, questioning the seriousness of the grounds used.
Ongoya further pointed to what he termed an imbalance in the trial schedule, stating that Gachagua’s side was allocated limited time to challenge multiple witnesses, which he said undermined fair hearing standards and proper judicial accountability.
