Judge Orders Closure of B-Club, Kiza Over Noise Pollution in Kilimani

On October 29, 2019, Justice Loice Komingoi of the Environment and Land Court ordered the closure of B-Club Nairobi, Kiza Restaurant and Lounge, Space Lounge and Grill, and Explorers Tavern in Kilimani due to noise pollution and property value degradation.

The court ruling came after residents, represented by Kilimani Project Foundation through lawyer Cecil Miller, complained about the noise from the four nightclubs, which deprived them of sleep and affected property prices.

The residents also alleged that the clubs littered the area, obstructed vehicles, and exposed children to immoral and indecent behavior.

The court heard that the noise levels from the clubs clocked between 68 to 84 decibels, which is above the permitted levels.

However, the clubs argued that they had complied with city by-laws and had implemented measures to reduce noise levels, including sound-proofing and installing acoustic speakers.

Despite the clubs' claims, Justice Komingoi ruled in favor of the residents, stating that their right to a clean and healthy environment had been infringed by the activities of the clubs.

The judge also criticized the Nairobi County Government for being reluctant to exercise its mandate and address the noise pollution complaints.

The closure of the clubs has been suspended for 30 days to allow them to pursue an appeal.
