On September 26, 2019, the Environment and Land Court issued an order halting the Kenya Medical and Research Institute's (KEMRI) development of a 100-acre land in Mwea for a proposed Sh10 billion ultra-modern teaching and referral hospital.

Recently, KEMRI's lawyer, Wilfred Lusi, sought to vary the order, claiming a contractor was already on site. However, Judge Enock Cherono declined, stating that Lusi had not filed the necessary documents or served the other parties involved.

Cherono emphasized that it is improper to seek court orders without proper documentation and service to all parties. The court allowed Lusi to file his application within 14 days, with the respondents required to file their responses within the same period.

The matter will be heard on November 13, 2019. The dispute revolves around allegations that KEMRI failed to involve area residents in the project, as required by the Constitution.
