Court Petition Seeks to Block Mariga's Kibra By-Election Bid

On October 18, 2019, a voter from Kisumu, Bernard Ongir, moved to court seeking orders to have McDonald Mariga, the Jubilee candidate, barred from contesting in the Kibra by-election.

The voter claims that the Electoral and Boundaries Commission (IEBC) cleared Mariga to run under unlawful circumstances.

Listing the IEBC and Mariga as respondents, Bernard filed the petition under a certificate of urgency, seeking to suspend the Kibra by-election indefinitely until the IEBC corrects alleged anomalies that led to Mariga's inclusion in the by-election.

The case was transferred to the Constitutional and Human Rights Division court in Nairobi by Kisumu High Court Judge Fred Ochieng.
