Lawyer Assa Nyakundi, who was arrested and arraigned over the fatal shooting of his son Joseph Nyakundi, has yet to take plea seven months after the incident on March 17 this year in Muthaiga, Nairobi.
Published on October 17, 2019, the case was initially set for plea on Tuesday, October 16 before Justice Jessie Lesit, who directed the case to be taken back to Justice Daniel Ogembo due to her inability to handle new matters.
Justice Lesit, who was promoted to a court of appeal judge, cited her inability to handle new matters as the reason for the case transfer.
Lawyer Assa Nyakundi was initially due to be charged with manslaughter in April, but the case has been delayed multiple times due to various reasons, including the prosecution's request for a mental test at Mathari Hospital and the defence lawyer's opposition to the application.
On July 18, Justice Lesit issued an order barring Senior Principal Magistrate Teresia Nyangena from hearing any proceedings in the manslaughter case.
Despite multiple court appearances, Lawyer Assa Nyakundi has yet to take plea in the case, which has been ongoing for seven months.
