Kenya: Supreme Court Rules on Counties' Revenue Suit Jurisdiction

On October 8, 2019, the Supreme Court delivered a ruling on a case filed by counties regarding the Division of Revenue.

Justice Njoki Ndung'u dismissed the National Assembly's preliminary objection, stating that the Supreme Court has jurisdiction to determine the case.

However, the judge clarified that the court will not address all the issues raised by counties. A direction on specific issues the court will deal with will be given on October 16.

The controversy surrounding the Division of Revenue arose after the National Assembly and the Senate disagreed on the allocation for counties. The impasse was later resolved when the Senate accepted a Sh316.5 billion allocation proposed in the revised 2019 Division of Revenue Bill.
