On October 6, 2019, the Director of Public Prosecutions (DPP) Noordin Haji filed a petition with the Judicial Service Commission (JSC) seeking the removal of Deputy Chief Justice Philomena Mwilu from office.
The petition, which was filed on the grounds that Mwilu is not fit to continue holding office, alleges that she has used her status to enrich herself, evade taxes, and engage in inappropriate communication with suspects in criminal cases.
According to the petition, Mwilu was given a loan by a bank even though she had not applied for it and was therefore not appraised for her creditworthiness as required. Instead, she dealt directly with the bank's managing director.
The DPP also alleges that Mwilu engaged in inappropriate communication with one Omar Ikumu Arafat, who was a suspect in two cases before the Nairobi Milimani Chief Magistrates' Court.
However, the DPP's challenge will be to prove his case based on evidence the High Court had found to have been acquired illegally.
