Court Halts Motor Vehicle Leasing Tender Over Alleged Irregularities

On October 2, 2019, a Kenyan court intervened in a dispute surrounding a motor vehicle leasing tender, halting the process after a company raised concerns over alleged irregularities.

CMC Motors Group Ltd. petitioned the court, arguing that Interior PS Karanja Kibicho had advertised the tender through restricted tendering, before the expiry of the 14 days required by the law.

The company's lawyer, Migos Ogamba, claimed that the Public Procurement Administrative Review Board had failed to consider essential factors in dismissing the company's case, thereby breaching their rights and legitimate expectations.

Justice John Mativo subsequently suspended the decision and orders issued by the board for 14 days, instructing the evaluation committee not to accept, evaluate, or award the tender during this period.
