Published on September 14, 2019, a Kakamega man, Edward Musame Mulimu, has lost an appeal against his conviction for raping his 66-year-old grandmother in 2017.
High Court Judge Erick Ogolla affirmed the 10-year sentence handed down by Kakamega Senior Resident Magistrate Josephine Maragia, stating that the prosecution had established a case of rape against Mulimu beyond any reasonable doubt.
The incident occurred on February 2, 2017, at Milimani Estate, Kakamega East District, where Mulimu posed as a police officer and broke into the woman's hut, forcing her to have intercourse without her consent.
Justice Ogolla dismissed Mulimu's assertions that he had been framed up due to a pending land dispute at home between the complainant and him, terming his defence a 'mere denial' and an afterthought.
On a separate count, Mulimu was charged with committing indecent acts with an adult, inappropriately touching the woman's private part without her consent.
Justice Ogolla upheld the conviction and sentence, stating that the sentence meted out against Mulimu was indeed lenient as it's the minimum punishment provided for by the Sexual Offences Act.
