On June 26, 2020, Musalia Mudavadi's ANC party expelled Kakamega Senator Cleophas Malala from its membership, a move that has raised questions about its legality.
The party's officials, including Mr. Mudavadi, had seen their term expire, with a petition filed at the Office of the Registrar of Political Parties challenging the legitimacy of the party's leadership.
Senator Malala's expulsion was announced at a specially convened National Governing Council (NGC) meeting, attended by about 50 delegates who adopted the resolution of the National Executive Committee (NEC) on the report of the party's disciplinary committee.
According to ANC resolutions, the NGC adopted the decision to expel Mr. Malala, stating that he had been given adequate and fair chance to defend himself but had snubbed the invitations and called the party process and officials' names.
However, Senator Malala seemed to brush aside claims that he had been expelled from the party while moving the report in the Senate on a special committee that investigated the impeachment charges against Kirinyaga County Governor Anne Waiguru.
“Let me make it clear that I am still the Senator of Kakamega,” Mr. Malala spoke in the Senate yesterday.
Thursday, nominated MP Godfrey Osotsi, who is fighting his expulsion from the party in court, dismissed Senator Malala's expulsion as illegal, calling it a 'political joke of the year' and an 'exercise in futility.'
