In the latest twist to a years-long trail of fraud allegations, Kenyan businessman Julius Mwale has been named in U.S. court records over an eviction from a multimillion-dollar estate in Alamo, California, after failing to pay rent and issuing a $450,000 cheque that bounced.
The property, which Mwale and his wife Kaila had for years presented as their own and even “gifted” to other families, was in fact a rental — one they stopped paying for in October 2024, along with utilities and landscaping fees.
While the Contra Costa County Sheriff executed the eviction order against his family, Mwale remained in Kenya, continuing to market his contested investment ventures even as the legal fallout in the United States gathered pace.
According to court filings from Contra Costa County Superior Court (Case No. N24-2030), the landlord, MHF Holding Vier GmbH & Co. KG, had entered into a lease agreement with the couple in October 2021.
The arrangement not only covered the residence but also included the use of two high-end vehicles; a Bentley and a Mercedes, which Mwale frequently showcased in photographs and promotional material as signs of his supposed financial success.
The documents reveal that the couple’s non-payment led to arrears amounting to tens of thousands of U.S. dollars before the failed attempt to settle with a personal cheque for approximately $450,000, which was returned for insufficient funds.
The court subsequently ruled in favour of the landlord, granting judgment and authorising the eviction.
The eviction revelations surfaced through an email exchange in mid-July 2025 between Utah-based musician and businessman Mat Shaw, a former plaintiff in a fraud lawsuit against Mwale and Kenyan media contacts.
In the correspondence, Shaw describes the case as a “critical development” in exposing what he called the Mwales’ “fraud and ponzi scheme,” alleging that the decision to drop his own civil suit earlier this year was driven by evidence of the couple’s insolvency and the impracticality of recovering funds through litigation.
Shaw and his wife, Brooke, had previously sued Mwale and his wife in July 2024, claiming they had been misled into providing approximately $1.7 million for investment projects that failed to deliver promised returns.
That case was later withdrawn after a series of venue changes between courts in Utah and New York, with Shaw maintaining that the litigation had become economically unviable given the defendants’ financial position.
The eviction adds to a mounting record of disputes and controversies involving Mwale, including persistent allegations of unpaid bills to suppliers and contractors tied to his flagship and heavily promoted “Mwale Medical and Technology City” project in Kakamega County.
Investigations in November 2023 and later reports have documented multiple claims of bounced or delayed payments, as well as questions over the authenticity of claimed partnerships with global corporations.
In court filings related to the Shaw litigation, it was further alleged that Mwale invoked the names of prominent U.S. companies and officials without authorisation, a tactic purportedly used to attract investor confidence.
Under U.S. property law, an eviction of this nature, particularly one involving a high-value estate and such a substantial dishonoured cheque, typically signals severe liquidity problems or the collapse of credit arrangements.
The court outcome in California adds a rare element of verifiable documentation to a pattern of allegations that have trailed Mwale for years.
In Kenya, Mwale continues to promote his ventures without directly addressing the U.S. case, leaving open questions about how the eviction will influence his ability to attract capital or secure agreements in the months ahead.
