The Court of Appeal has rejected President William Ruto’s bid to suspend a High Court order requiring him to reconstitute his Cabinet to comply with the two-thirds gender rule, leaving the directive in force after the deadline expired.

In its ruling on Thursday, October 29, the appellate court also directed Attorney General Dorcas Oduor to serve court papers as proceedings continue.

On June 30, a three-judge bench ruled that the Cabinet violated Article 27(8) of the Constitution, with only seven women among its 25 members, against the minimum nine required.

The court gave Ruto 120 days to comply, setting October 28 as the deadline.

The government sought suspension pending appeal, but the court declined, intensifying scrutiny over constitutional compliance and the Executive’s response to court orders.
