An outsourced employee at Steel Structures Limited in Nairobi has raised serious concerns over what they describe as unfair working conditions, forced unpaid work, intimidation and physical assault at the company.

The employee, who has requested complete anonymity for fear of losing their job or facing further retaliation, says outsourced workers are being required to report to work on days when permanent employees are protesting or taking industrial action.

According to the insider, the outsourced workers are expected to continue working during such periods but are not given additional payment for the extra work.

The situation, the employee claims, has created a difficult choice for outsourced staff who fear that refusing to report to work could have consequences for their employment.

The insider says that workers who decline to report have been threatened with losing access to overtime opportunities, termination of their contracts and other forms of intimidation.

More seriously, the employee says that some workers have been subjected to physical assault while on duty, including being slapped.

The worker claims that the pressure is particularly difficult for outsourced employees because their employment arrangements leave them feeling vulnerable to management decisions.

According to the complaint, employees fear that speaking openly about their concerns could result in their contracts being terminated or their access to overtime being withdrawn.

The employee has linked the concerns to the leadership of Steel Structures Limited, naming CEO Sonaar Shah and Company Director Sarju Shah.

The insider also claims that the company's founder, Jayandra Shah, is aware of the situation involving outsourced workers.

The worker says the concerns are not about seeking special treatment but about receiving fair compensation for work performed and being allowed to raise workplace concerns without fear.

"We feel trapped because speaking up could cost us our jobs, while continuing to work without proper compensation is also unfair," the employee said.

The insider is also appealing for protection against what they describe as intimidation and possible racial retaliation when employees raise legitimate workplace complaints.

The allegations raise broader questions about the treatment of outsourced workers in workplaces where permanent employees and contracted workers may operate under different employment arrangements.

At the centre of the complaint is a simple demand from the workers: fair treatment, proper payment for work performed and protection from intimidation or retaliation.
