The Employment and Labour Relations Court has upheld KeNHA's requirement that applicants for Engineer (Roads) positions must hold engineering degrees and be registered with the Engineers Board of Kenya (EBK), dismissing a petition by the Institution of Engineering Technology of Kenya (IET-K).

The court ruled that engineers and engineering technologists are distinct professions with different training, qualifications and legal mandates. The decision clears the way for KeNHA to proceed with recruitment that had been stalled since December 2025.
