On April 28, 2020, the SRC wrote to the Treasury Cabinet Secretary directing him to pay the Covid-19 medical emergency allowance and benefits for frontline health workers in the national and county governments.
However, the Kenya Association of Health Administrators (KAHA) claims that they were unjustifiably omitted from the list of beneficiaries of the emergency allowance, despite being responsible for supervising other beneficiaries and ensuring the smooth running of hospital operations.
Through their lawyer, Danstan Omari, KAHA has filed a case under certificate of urgency at the Employment and Labour Relations Court in Nairobi, seeking temporary orders to stop the implementation of the SRC’s directive until the matter is dispensed with.
Omari stated, 'Our prayer is that the court issue conservatory order staying the implementation of the directive until the case is heard and determined.'
The court has been urged to ensure the matter is dealt with expeditiously, either through video conferencing or electronic means, due to the Covid-19 pandemic.
Omari added, 'In view of the Covid-19 pandemic, the court should ensure the application and the petition herein is heard through electronic means.'
The case has been filed against the SRC, the Ministry of Health, the Treasury, the Attorney General, the Kenya Health Professionals Association, and the Councils of Governors.
