On May 12, 2020, the Political Parties Disputes Tribunal issued a landmark ruling that quashed a post-election coalition agreement between Jubilee Party and KANU, declaring it illegal.
The tribunal found that the agreement between Jubilee and KANU violated the constitution and the Political Parties Act, rendering any decisions made under the pact invalid and unlawful.
Responding to an appeal by Soy MP Caleb Kosgey, Nakuru Senator Susan Kihika, Mumias East MP Benjamin Washiali, and Albert Mutai, the tribunal declared that any decision founded on the coalition agreement signed between Jubilee and KANU had no effect in law.
The ruling also issued an injunction restraining Jubilee Party Secretary General Raphael Tuju and Acting Chairman Nelson Dzuya from making any coalition agreements on behalf of Jubilee Party with any other party or parties without a valid formal resolution of a duly convened National Executive committee of the Jubilee Party.
The decision gave besieged Elgeyo Marakwet Senator Kipchumba Murkomen and his Nakuru counterpart Susan Kihika temporary reprieve after they were ousted as Majority Leader and Majority Whip respectively during a Jubilee coalition Parliamentary group meeting at State House on Monday.
