Three Brothers Found Guilty of Murdering Elderly Man in Nakuru

On October 15, 2016, a tragic incident occurred in Nyakinya village, Njoro Sub-county, within Nakuru, where 74-year-old Francis Njuguna was brutally murdered by three brothers.

Justice Janet Mulwa delivered her judgement through a video-link, stating that statements from seven witnesses, including Njuguna's son Samuel Gakuna, placed the brothers at the crime scene and implicated them in the murder beyond doubt.

According to Gakuna's testimony, the brothers started beating him, claiming he had stolen their television set. Njuguna intervened, but was hit on the head with a stick by Joseph Simiyu, causing him to fall to the ground. The two other brothers continued beating Njuguna.

Ms Mulwa faulted the accused for killing an unarmed old man who was intervening on behalf of his son. The accused defended themselves, claiming they never attacked the deceased nor his son, and that they never knew the two. However, Mulwa dismissed their defence, terming their statements as fabrications.

Ms Mulwa stated, 'I am satisfied without a doubt that the accused persons, and no other persons, committed the heinous offence and they must suffer the consequences of their unwarranted and unlawful actions.'
