On May 9, 2020, Principal Magistrate Joe Omido made a ruling via video-link application, Zoom, clearing Joshua Waiganjo of impersonation charges after a seven-year court battle.
Waiganjo, along with former Rift Valley provincial police boss John M’mbijiwe and former Anti-Stock Theft Unit Commandant Michael Remi Ngugi, had been accused of masquerading as police officers.
However, Omido ruled that the prosecution's case failed due to lack of sufficient evidence to prove the defendants' guilt.
He noted that the prosecution witnesses were inconsistent during cross-examination and failed to provide evidence to prove Waiganjo's impersonation of a top police officer.
Omido also faulted the prosecution for leaving out crucial witnesses, including arresting officers and the investigating officer in the case.
Waiganjo was arrested in 2013 for allegedly masquerading as a senior police officer, and the case was heard by three judges in Nakuru and Naivasha, with over 40 witnesses testifying.
