On May 8, 2020, the High Court of Kenya ruled in favor of the children of the late businessman Njenga Karume, ordering the removal of three administrators from his estate.
Justice Roseline Aburili found that the trustees, George Ngugi Waireri, Kung'u Gatabaki, and Margaret Nduta Kamithi, had failed to act in the best interests of the beneficiaries, including Karume's grandchildren.
The court also ordered the trustees to account for all transactions undertaken since February 24, 2012, and to prepare and file the accounts in court within the next six months.
Justice Aburili noted that the relationship between the trustees and beneficiaries had deteriorated and irretrievably broken down, jeopardizing the proper administration of the trust.
The court's decision comes after a protracted legal battle between the children of Njenga Karume and the trustees, who had asked to continue serving as administrators.
The family had previously lost a battle to save its flagship asset, the Jacaranda Hotel, from being auctioned.
