On Friday, April 24, 2020, Sports Disputes Tribunal (SDT) chairman John Ohaga reaffirmed his ruling from March 17, 2020, nullifying the Football Kenya Federation (FKF) elections and ending the term of the FKF National Executive Committee.
Ohaga's decision comes after FKF chose not to appeal the March 17 ruling, allowing him to reiterate his pronouncements. In a communication, Ohaga stated that Fifa had declined to form a Normalisation Committee as requested in his earlier decision.
Ohaga invited representations from the parties on the next course of action, considering the urgent need for FKF to hold elections once the Covid-19 pandemic is behind us.
He also directed the Interested Parties in SDT Case No. 3 of 2020 and the Petitioners in SDT Case No. 5 of 2020 to make a formal application regarding the issue of protection of FKF assets and alleged vandalisation of the said assets.
Ohaga set a deadline of five days for the application, including brief written submissions, to be filed and served electronically. The Football Kenya Federation was also directed to file and serve its response within five days from the date of service upon it of the intended application.
The Tribunal will convene on Tuesday, May 5, 2020, at 3.00 pm via Zoom or such other medium as the Tribunal shall determine to hear brief arguments on the application and with respect to direction 2 above.
