On Tuesday, March 3, 2020, a Nairobi court session witnessed a public display of the simmering differences between DPP Noordin Haji and DCI George Kinoti.
Kenya Ports Authority Managing Director Daniel Manduku was freed by the court after appearing alongside Mr. Safari Lewis.
The court's decision was based on the absence of a charge sheet authorized by the DPP, with Senior Principal Magistrate Kennedy Cheruiyot ordering the duo's release.
However, the investigating officer produced a charge sheet authorized by the DCI, which was subsequently disowned by the prosecution in court.
Later, a senior state prosecutor claimed that the DPP had recalled the case file and directed the duo's release on a police bond.
Despite the prosecution's claims, the Magistrate sided with the defence lawyers, agreeing that the two be freed and not held in custody.
Mr. Manduku is set to face charges related to the unlawful awarding of tenders for cargo storage facilities at the Nairobi Inland Container Depot (ICD).
