Tax Appeal Tribunal Delivers 23 Judgments

The Tax Appeals Tribunal has made a significant impact in Kenya's tax landscape, delivering 23 judgments with a revenue implication of Ksh11 billion.

According to Paul Matuku, Commissioner for Legal Service at the Kenya Revenue Authority (KRA), the tribunal judgments were delivered on December 17 and 18, 2019.

The appeals tackled by the tribunal in December related to various tax issues, including Withholding Income Tax, tax on winnings from lotteries and betting, Customs under declaration on values of imports, Corporation tax, Pay as You Earn (PAYE), Excise Duty (Domestic), and VAT refunds claims.

The tribunal, which was established in June 2019, has presided over 112 appeals with disputed tax amounting to Ksh53 billion.

Matuku expressed optimism that more taxpayers will embrace the tribunal as a key arbitrator of first call, avoiding lengthy and costly litigation processes.
