On January 13, 2020, High Court Judge John Mativo directed Attorney General Kihara Kariuki to provide an advisory opinion on the State's disobedience of court orders regarding the return of lawyer Miguna Miguna.
According to reports, Miguna was blocked from checking into two airlines last week after he sought to return to Nairobi from a two-year exile in Canada. High Court judge Weldon Korir had ordered the government to facilitate Miguna's return unconditionally.
However, Government spokesperson Col. (Rtd) Cyrus Oguna claimed that allowing Miguna into the country without valid documents would amount to a breach of international aviation regulations. Oguna further stated that the lawyer was categorized as an unruly passenger in line with International Civil Aviation Organisation standards.
The case will be mentioned on Tuesday next week.
