Japan's Fair Trial for Ghosn: A French Lawyer's Concerns

On January 10, 2020, Japanese Justice Minister Masako Mori responded to former Nissan chairman Carlos Ghosn's criticism of Japan's legal system. Ghosn had described the system as allowing him 'zero chance' of a fair trial, justifying his escape to Beirut.

However, Ghosn's lawyer, Francois Zimeray, a French lawyer, argued that it was Japan's prosecutors who should prove Ghosn's guilt, not the other way around. Zimeray stated, 'It belongs to the prosecution to prove guilt and not to the accused person to prove its innocence.'

As a result, Zimeray claimed that Japan's authorities had failed to arrange for a fair trial that respected universal rights.
