City Woman's Attempt to Withdraw Rape Case Declined

On November 13, 2019, Margaret Waithera Kariuki reported her boyfriend, Lawrence Wambugu Mwangi, to the authorities, alleging he had caused her aggravated bodily harm and attempted rape.

Fast forward to a court hearing, where Waithera sought to withdraw the case, citing her close relationship with the accused.

However, Nyahururu Senior Resident Magistrate Ocharo Momanyi was not convinced by Waithera's decision, stating that the case would proceed to trial due to the severity of the charges.

"In the interest of justice and regard for the magnitude of charges before the accused, this matter should aptly proceed to trial," the magistrate ruled.

Wambugu had previously denied the charges of rape, attempted rape, and assault, and was remanded at Thomson Falls G.K Prison.

The prosecution was ordered to provide all witness statements to the defence lawyers, with the matter set to be mentioned on January 16, 2020, and heard on March 3, 2020.
