On January 6, 2020, Nairobi Governor Mike Sonko nominated Anne Mwenda as his Deputy Governor, citing the need for continuity following his suspension from office due to graft allegations.
According to Article 180(5) of the Constitution, a County Governor has the authority to nominate a person qualified for election as County Governor or Deputy Governor. The Council of Governors, led by Chair Wycliffe Oparanya, has confirmed that Sonko's nomination was in line with this provision.
However, the Director of Public Prosecutions (DPP) Noordin Haji has disputed the nomination, stating that it is illegal due to Sonko's bail terms, which prohibit him from executing County functions until his corruption case is heard and determined.
The County Assembly has been urged to expedite the vetting process of the nominee in accordance with their mandate for purposes of appointment.
As the nomination process unfolds, Governor Sonko has vowed to abide by the court's bail terms, ensuring that his suspension does not interfere with the operations of the county or service delivery to residents.
