Government to Facilitate Entry of Miguna Miguna

On January 6, 2020, the Kenyan government announced that it would facilitate the entry of lawyer Miguna Miguna into the country, following a court order issued on December 14, 2018.

According to a statement from the Immigration Department, the government will comply with the court orders and allow Miguna to enter the country.

Miguna, who had been living in Canada, had departed for Nairobi on January 6, 2020, and had requested that the government grant him entry into the country, stating that he is a Kenyan citizen whose fundamental rights must be respected.

“I'm not asking for any special treatment. I have never sought so-called "red carpet" treatment. I want and demand all my rights and fundamental freedoms to be respected. I want my valid Kenyan passport back. I want court orders to be obeyed and complied with. I must enter Kenya unconditionally as a Kenyan,” Miguna posted on his social media page.

His legal team, led by lawyer Dr. John Khaminwa, had moved to Milimani Law Court seeking orders that would bar State agencies from interfering with his return.

“The Application has been necessitated by the refusal by the State to comply with numerous court orders following his removal by some Government officials from Kenya,” Khaminwa said.

The government had previously denied Miguna entry into the country, citing that he had no valid documents to depict that he was a Kenyan citizen.

However, the court order issued on December 14, 2018, by Justice Chacha Mwita, directed the government to facilitate Miguna's entry into the country.
