On January 5, 2020, the Public Accounts Committee (PAC) expressed concerns over the award of a Sh42.6 million tender for the construction of a Huduma Centre in Mandera.
The State department for Youth, Public Service and Gender had awarded the tender through a restricted process, citing Section 102(1) (b) of the Public Procurement and Asset Disposal Act 2015.
However, the committee found that no evidence was provided to justify the use of a restricted tender, which is only allowed in exceptional circumstances.
According to a report adopted by the National Assembly last month, the committee observed that the accounting officer (principal secretary) had used the restricted tender method without sufficient justification.
As a result, the committee recommended that the Director of Public Prosecutions should prosecute those found culpable within three months.
