Miguna Miguna has filed an urgent application at the Milimani High Court in Nairobi, seeking orders to ensure a smooth return to Kenya. The application, filed through lawyer John Khaminwa, aims to restrain the State from interfering with his return.

According to Khaminwa, the application has been necessitated by the State's refusal to comply with numerous court orders following Miguna's removal from Kenya. The lawyer wants the court to certify the application as urgent and hear it on a priority basis during the Christmas recess.

The respondents in the matter include Interior Cabinet Secretary Fred Matiang'i, Director of Immigration Gordon Kihalangwa, former Inspector General of Police Joseph Boinett, Director of Criminal Investigations George Kinoti, Mohamed Said, officer in charge of the defunct Flying Squad, OCPD Jomo Kenyatta International Airport, and the Attorney General.

Miguna wants the court to order the State to facilitate his entry into Kenya on January 7, or any other date, based on his identification through his national identity card or Kenyan passport. He also wants the Registrar of the High Court to release his Kenya Passport No. A116842 to his lawyers or an authorised officer of the Kenya National Commission on Human Rights for use by Immigration officers in his identification at the airport.
