On December 25, 2019, a Nyamira Court made a landmark ruling in favor of the family of Evans Moya Moindi, a driver who died in a road accident on January 1, 2016, while on duty for Kisii County Government.
Moindi's father, Jackson Moindi Ontegi, had sued Kisii County Government and Kisii Governor James Ongwae for damages following his son's death.
According to the court, evidence presented proved that the defendants were wholly to blame for the accident, and they were ordered to pay Moindi's family a total of Sh5.3 million.
The court applied a two-thirds dependency ratio, taking into account the salary Moindi could have earned for 28 years until retirement, which would have been Sh5.1 million. The additional Sh200,000 was awarded as a result of the dependency ratio.
