The Importance of Taking Leave Days on Time

As the festive season approaches, many employees in Kenya are looking forward to taking their well-deserved leave days. But do you know the importance of taking your leave days on time?

According to Human Resource experts, leave days are crucial for both employees and employers. Mr. Luke Anami notes that leave days allow staff to balance between work and other duties, improving individual performance and that of the company.

"A proper leave management also means that the business can operate more effectively, employers meet employees' need for time-off, and you satisfy your legal obligations," he adds.

Janet Martin, another Human Resource expert, explains that permanent employees are entitled to 25 days of leave in a year, while those on contract get 24 days-off. Unionisable employees, on the other hand, can get up to 40 days or more.

But what happens if an employee fails to take their leave days? Mr. Anami warns that it can prove costly to the company, as a fatigued member of staff is not likely to perform duties fully, and cases of sickness will be witnessed, impacting on the overall performance of the company.

Under the Employment Act, annual leave is 21 working days, during which the employee is entitled to full pay. However, this can be taken in proportion with the agreement of the employer and employee, although the law allows that one part of the agreed period consists of at least two uninterrupted working weeks.

It's worth noting that annual leave is exclusive of public holidays and weekly rest days. While 21 days is the minimum, many contracts and collective agreements provide for annual leave of between thirty to forty-five days.

So, if you're an employee in Kenya, make sure to take your leave days on time to avoid any potential consequences. And if you're an employer, ensure that you're adhering to the law and providing your employees with the leave they deserve.
