On December 20, 2019, the High Court dismissed Kiambu Governor Ferdinand Waititu's application for review of his Ksh. 15 million cash bail.
Waititu had sought to have his bail terms reviewed, claiming he was unable to raise the Ksh. 15 million ordered by the court.
However, the High Court ruled that setting bail is a discretion of the judiciary and upheld the ruling that instructed Waititu to stay out of office pending determination of his case.
According to the ruling, 'It does not amount to his removal from office. I agree it only amounted to a constructive measure. Neither the judge or the magistrate purported to remove him from office. He's still the governor…judge can't be accused of having removed him from office.'
Waititu and his wife Susan Wangari are embroiled in a corruption case over an alleged Ksh. 588 million tender that is said to have been irregular.
On Thursday, the Kiambu County Assembly voted to impeach Governor Ferdinand Waititu over alleged gross misconduct and abuse of office.
His fate as Kiambu County Governor now lies in the hands of the Senate and the courts.
