Court Acquits Two Journalists Over Willful Obstruction Charges

On December 18, 2018, a Bondo court acquitted two journalists, Brian Ondeng of the Kenya News Agency and Geoffrey Oguma of Radio Nam Lolwe, of willful obstruction of police charges.

Principal Magistrate Edwin Wasike ruled that the prosecution failed to meet the threshold of willful obstruction of police in discharging their duties, as stated in Section 103 of the Police Act.

Wasike stated that the journalists were only curious about the incident and had no intention to obstruct the police, as they were attempting to cover the arrest of a shylock.

The prosecution alleged that the journalists were arrested in Bondo town in December 2018 and assaulted by the police after they went to cover the recovery of auctioned goods by a shylock firm.
