On December 17, 2019, the Council of Governors (CoG) announced plans to challenge a court ruling that bars governors facing criminal charges from office.

The move comes after a ruling by Lady Justice Mumbi Ngugi on July 24, 2019, which locked Kiambu Governor Ferdinand Waititu from his office.

CoG chair and Kakamega Governor Wycliffe Oparanya stated that the ruling had adversely affected operations in three counties, including Nairobi, Samburu, and Kiambu.

Speaking in Nairobi, Oparanya said the CoG would seek guidance from the Attorney-General or the Supreme Court to overturn the ruling.

He noted that the ruling had created an impasse in Nairobi, where Governor Mike Sonko was arrested and arraigned over irregular payments amounting to Sh357 million.

With Sonko's arraignment, governance in the city county has been thrown into a spin due to the lack of a deputy, as Sonko has governed on his own since the resignation of Polycarp Igathe on January 12, 2018.
