Kirinyaga Governor Anne Waiguru has taken drastic measures against King Kaka, ordering him to pull down his song Wajinga Nyinyi from all social media platforms and apologize in writing or face a lawsuit.
Waiguru, through her lawyers Kiragu Wathuta & Company Advocates, has given King Kaka 48 hours to issue an unconditional admission of liability in writing, apologize in writing, and delete the song. Failure to comply will result in Waiguru moving to court to sue for defamation.
Waiguru has also demanded a retraction of the song and an unconditional commitment from King Kaka not to release any further defamatory songs against her.
According to Waiguru, the song's release has occasioned 'grave, irreparable, and permanent damage' to her reputation. She accuses King Kaka of tarnishing her name to increase his popularity and profits.
Waiguru has released a litany of demands to King Kaka, which she wants met by December 14, 2019. These demands include an unconditional admission of liability, an apology in writing, and the deletion of the song. Failure to comply will result in Waiguru suing for damages.
Waiguru has also threatened to seek orders for the immediate closure of King Kaka's Twitter account.
She claims that the remarks about her in the song are highly defamatory and depict her as corrupt and having engaged in the theft of public funds at the National Youth Service (NYS).
Waiguru has warned the media through the Media Council of Kenya against publishing, airing, or disseminating the defamatory song.
