On December 12, 2019, Senators Mutula Kilonzo Junior and Kipchumba Murkomen appeared in court as part of Nairobi Governor Mike Sonko's legal team in a graft case.

Law Society of Kenya (LSK) Mombasa branch chairman Matthews Nyabena defended the society's members who have taken up roles as legislators, saying they can choose whoever they want to represent in a court of law.

According to Nyabena, the Constitution does not establish a bar against lawyers representing clients of their choice, leaving the government with no option but to challenge such decisions in court.

President Uhuru Kenyatta had earlier faulted state officers for participating in corruption cases while serving in positions meant to oversee, describing the trend as a case of conflict of interest.

On Jamhuri Day, Kenyatta directed Attorney General Paul Kariuki to come up with a Conflict of Interest bill to bar public officers from engaging in other professions.
