On December 13, 2019, Kenya's competition authority gave its greenlight for the merger of Airtel Kenya and Telkom Kenya, subject to certain conditions.
The Competition Authority of Kenya (CAK) published a notice in the Kenya Gazette outlining the conditions for the approval, including the retention of employees and honouring existing government contracts.
According to the notice, the merged entity, Airtel-Telkom, must retain at least 349 of the 674 employees of Telkom Kenya, with specific conditions for their retention.
The company is also required to honour all existing government contracts and not sell or transfer certain operating and frequency spectrum licences until their duration expires.
Additionally, Airtel-Telkom will not be allowed to enter into any other sale deal in the next five years, except in the event of a failing firm, in which case a forensic audit will be conducted at the cost of the merged entity.
