On December 13, 2019, the Competition Authority of Kenya (CAK) gave its greenlight for the merger of Airtel Kenya and Telkom Kenya, paving the way for the creation of Airtel-Telkom.
According to a notice published in the Kenya Gazette, the regulator set out a raft of conditions for the deal, including ensuring that at least 349 of the 674 employees of Telkom Kenya are retained.
"The merged entity shall ensure that at least three hundred and forty nine (349) of the six hundred and seventy four (674) employees of the target are retained as follows," CAK boss Wang'ombe Kariuki said.
The conditions also include honouring all existing government contracts, not selling or transferring certain operating and frequency spectrum licences, and not entering into any other sale deal in the next five years.
However, in the event of any indication of a failing firm within the period, the Communications Authority shall conduct a forensic audit at the cost of the merged entity.
