Kirinyaga County MCAs' Fate Hangs in Balance After Court Ruling

December 13, 2019, marked a significant day for Kirinyaga County as the High Court ruled in favor of 12 elected MCAs who were removed from chairing various assembly committees four months ago.

Justice Lucy Gitari, the presiding judge, declared the removal of the MCAs as 'unprocedural' and a violation of their fundamental rights. The judge noted that the removal took place on August 16, when there was no assembly speaker, as David Githanda had tendered his resignation on July 31.

The leader of the majority, Kamau Murango, vowed to exploit the loopholes pointed out by the court to dislodge the 12 MCAs. The MCAs who were removed include Gudson Muchina, Fredrick Bundi, Pius Njogu, Peter Njomo, Sammy Maina, Johnson Muraguri, Kinyua Wangui, Mathew Ireri, Harrison Ngiria, Andrew Gitari, and Patrick Chomba.

The assembly is yet to elect a substantive speaker, with Joel Wagura serving as the acting speaker. The current assembly has 20 elected MCAs and 13 nominated ones.
