Kenya: Court Nullifies CUE's PhD Rule, Says Lecturers Not Consulted

On December 11, 2019, a Labour court Judge in Kenya declared null and void a regulation by the Commission for University Education (CUE) requiring all lecturers to have a doctorate degree by the end of 2019 to continue teaching in universities.

The ruling was made by Justice Stephen Radido in a case filed by lecturers at Machakos University early in 2019.

The lecturers had petitioned the Employment and Labour Relations Court, citing breach of the Constitution and the Employment Act, 2007, as they were not consulted when the regulations were being developed.

Justice Radido noted that vice chancellors and principals, who represented academic staff during the process, epitomised the employer and their interests did not represent those of employees.

He further ruled that a permanent injunction be issued against the respondents from implementing the policy.
