On November 21, 2019, Makueni Governor Kivutha Kibwana filed a civil suit against blogger Cyprian Nyakundi through Nyamu and Nyamu Company Advocates.
The suit, Number 234 of 2019, seeks to restrain Nyakundi from further publishing content deemed defamatory to the governor.
The controversy began when Nyakundi published an article on his blog that touched on the governor's lifestyle.
As a result, Nyakundi was set to appear for an inter partes hearing on November 26, 2019, at 9:00 am.
According to the notice, Nyakundi was restrained from further publishing defamatory statements about the governor and his family pending the hearing and determination of the application.
This is not the first time Nyakundi has been sued for his blog posts. In May 2018, he was arrested and taken to the DCI headquarters for questioning over claims he made against some parties.
However, in July 2019, Justice Wilfrida Okwany ruled that Section 84 (d) of the Kenya Information and Communication Act (KICA) was unconstitutional, paving the way for Nyakundi's successful challenge of the law.
