On October 19, 2012, Mary Amwayi was traveling from Bungoma to Kakamega in a vehicle owned by Bluemarks Shuttle when they were hit by a trailer owned by Imma Hauliers.
Amwayi was left with a disfigured face and her thighs badly injured by the impact of the accident. She was treated at the St Marys Hospital Mumias and discharged on April 8, 2013.
Justice William Musyoka of the Kakamega High Court has ordered Imma Hauliers and Bluemarks Shuttle to pay Amwayi Sh1,182,505 for occasioning her life-threatening injuries.
Justice Musyoka dismissed an appeal filed by the transport companies, which had sought a review of the sum awarded, describing it as high and unreasonable.
According to the judge, the award was reasonable because Amwayi was hospitalized for over five months.
Amwayi had sued the two transport companies, saying the vehicles were negligently driven without due care and attention.
