On December 4, 2019, the High Court of Kenya ordered the immediate suspension of the enforcement of revised parking fees in the Nairobi CBD, pending a hearing. The decision was made in response to a petition filed by COFEK, a consumer rights organization, against the new tariffs.
According to the revised parking fees, motorists were required to pay Ksh400 to park in the Nairobi CBD, effective from Wednesday. However, COFEK argued that the Nairobi City County did not give motorists adequate time before effecting the changes and that the public was not notified when the Finance Act was enacted into law on September 25.
Justice James Makau, who made the ruling, stated that the new rates would remain suspended pending further directions by the court, which is slated to convene on January 21 for a hearing.
COFEK's petition was met with opposition from the Nairobi County Government, which argued that the executive was enforcing a law enacted by the legislative assembly. However, the court ultimately ruled in favor of COFEK, suspending the enforcement of the revised parking fees.
