Court Suspends Higher Parking Fee in Nairobi

On December 4, 2019, the Nairobi City County government doubled parking fees within the central business district from Sh200 to Sh400, effective immediately.

However, the Consumer Federation of Kenya (Cofek) was not pleased with the sudden change and decided to take action. Through city lawyer Henry Kurauka, Cofek sued the Nairobi City County government, arguing that the notice given to the public was too short, unreasonable, punitive, and discriminatory.

High Court Judge James Makau agreed with Cofek's argument and temporarily suspended the increment in parking fees pending the hearing and determination of the case. He directed that the case be heard on January 21, 2020.

According to Judge Makau, Mr. Kurauka had made a prima facie case since city residents would suffer the ripple effects of increased fees. He also noted that the county lawyer, Harrison Kinyanjui, had raised an objection to the granting of conservatory orders, but it was declined by the court.

As a result of the High Court order, motorists will now pay the old charges (Sh200) as they await the ruling on the matter.
