Woman Sues Hospital for Negligence in Newborn's Death

On February 28, 2013, Gladys gave birth to a baby with severe cerebral palsy at a Nairobi hospital, an incident she claims was caused by the hospital's negligence.

According to court documents, Gladys's lawyers stated that the hospital breached its duty of care, resulting in the delayed delivery and subsequent damage to Gladys and her baby.

They alleged that Gladys suffered a cervical tear and that the baby's severe cerebral palsy and subsequent death were a direct result of the hospital's actions.

Gladys was admitted to the hospital on her due date and was induced at 7pm. She went into labor at 1am but fell asleep until the next day when she gave birth.

When the baby was removed, it failed to cry and looked dull, but doctors assured Gladys that the baby was just in distress and that everything would be okay.

However, the baby's condition worsened, and it was diagnosed with pneumonia and brain damage. The baby died at 10 months old.

The Kenya Hospital Association has denied the claims, stating that the hospital acted reasonably and that any loss or damage suffered by Gladys was not occasioned by the hospital or its servants or agents.

High Court judge Cecilia Githua has given the hospital more time to file responses to the case.
