Football Kenya Federation Polls Annulled Over Irregularities

On December 3, 2019, the Sports Dispute Tribunal in Kenya made a landmark ruling that annulled the Football Kenya Federation's (FKF) presidential polls and branch elections.

The tribunal, led by chairman John Ohaga, ruled that the electoral board was improperly constituted due to the ineligibility of its chairman Edwin Wamukoya and member Elynah Sifuna-Shiveka.

The FKF had been accused of failing to engage stakeholders in the formulation of the Electoral Code of Football Kenya Federation 2019, and of appointing board members without involving them.

The tribunal also found that some members of the board were ineligible due to conflict of interest and mandatory prohibitions under the FIFA Electoral Code and the electoral code.

As a result of the ruling, the FKF has been ordered to engage its stakeholders in public participation in the formulation of the Electoral Code, and to maintain the status quo at the FKF national executive committee until fresh elections are held in accordance with all laws, regulations, and statutes.

"We find that the election process has been marred by irregularities and the outcome of the process are therefore null and void," ruled the tribunal in a verdict contained on a 27-page document.
