On November 29, 2019, a court in Kenya advised the family of Brian Kibet, a 25-year-old man shot by police officers after jumping over a State House fence, to seek an out-of-court settlement for his criminal case.
Chief Magistrate Francis Andayi gave Kibet's family two more months to engage with the Director of Public Prosecutions (DPP) and seek a second medical opinion on Kibet's mental status.
Andayi's directive came after Kibet's father, Kevin Bera, failed to present a recent medical report from Moi Teaching and Referral Hospital to determine whether Kibet was fit for trial.
Earlier in July, the same court had allowed Kibet to be treated for a mental disorder.
Andayi had directed that Kibet be remanded at Kilimani police station as his family made plans for his treatment.
However, Bera urged the court to release his son so that the family could take him for treatment at a medical facility that would befit him.
Bera argued that confining Kibet in police cells would not help him and prayed that the court allows him to discuss with his family on the most suitable option for holding him.
