Nairobi Governor Mike Sonko's case against the Ethics and Anti-Corruption Commission (EACC) has been delayed for the third time, with Justice Onyiego declining to issue conservatory orders.
On Thursday, November 28, 2019, parties involved in the case waited for an hour for Justice Ngugi to hear the matter, only to be told that he was attending to an urgent personal matter.
Justice Onyiego ruled that the case had been wrongly listed before him and directed that it be heard before Justice Ngugi, who was seized of the matter.
He also directed parties to respond to an amended Notice of motion and Certificate of Urgency filed by lawyer Cecil Miller on behalf of Sonko.
According to court documents, Sonko wants a court order blocking his arrest and prosecution as well as the removal from office of EACC Director of Investigations Abdi Mohamud.
“EACC and Mohamud have showed open bias, discrimination and unprofessionalism in the conduct of their investigative role in relation to corruption and economic crimes as provided for in the Anti-Corruption and Economic Crimes Act No. 3 of 2003 by unlawfully, illegally, selectively and discriminately pursuing investigations against the petitioner,” Sonko says in court documents.
