On Thursday, November 28, 2019, Nairobi Governor Mike Sonko's urgent application against the Ethics and Anti-Corruption Commission (EACC) failed to be heard for the third time.
The matter was initially set to be heard before Justice John Onyiego in the morning, but parties were moved to Lady Justice Mumbi Ngugi's court due to Justice Onyiego's unavailability.
However, the matter could not proceed as Lady Justice Mumbi Ngugi was bereaved, and the court was unable to continue with the hearing.
Through his lawyer, Cecil Miller, Governor Sonko also sought to have the EACC Director of Investigations, Abdi Mohamud, step aside to pave the way for investigations into allegations of corruption and economic crimes levelled against him.
Justice John Onyiego directed the parties to respond to an amended Notice of Motion and Certificate of Urgency filed by lawyer Miller on behalf of Sonko by the close of business on Monday, December 2, 2019.
Additionally, in a separate case, Sirisia Member of Parliament John Walukhe received a reprieve after the anti-corruption court declined an application by the prosecution to introduce new evidence in the Ksh 297 million maize fraud case.
Magistrate Elizabeth Juma ruled that the application by the state to introduce new evidence lacked merit and would have reopened the investigations if allowed.
Finally, a man was charged with four counts of forging documents for a 2-acre piece of land valued at Ksh 70 million. Patrick Ndichu Mbugua denied the charges and was released on a cash bail of Ksh 5 million.
